Gambling License in Tobique in 2026: Costs, Requirements and How It Compares

Private Financial Services has supported gaming licence applications since 2012, for more than fifty B2B and B2C operators, across Curacao, Anjouan, Malta, the Isle of Man, Kahnawake and Estonia. We have also sat on regulatory working groups in several European countries.

The Tobique licence has become the most asked-about route in this market in two years, and for a reason that survives scrutiny: the issuing body exists, it has a statute behind it, and its legal theory carries a 28-year precedent that no court has struck down. That is a higher standard than several jurisdictions sold at the same price. This page sets out what the licence is, what it costs in 2026, where the residual risk sits, and which operators it suits.

What the Tobique Gaming Licence Is, and Who Issues It

Tobique First Nation, known in Wolastoqey as Neqotkuk, is a Maliseet community in New Brunswick, Canada. It is not a country and not a province, but an Indigenous nation asserting jurisdiction over gaming conducted from its territory.

The Tobique Gaming Commission issues the licence under the Tobique Gaming Act, enacted in 2023. Licensing opened in late 2023, the first licence was granted in March 2024, and roughly eighty-four have been issued since.

The Commission works through Differentia Licensing Advisory Group Limited, appointed as the sole body recommending issuance on Tobique’s behalf. A DLAG compliance subscription is mandatory and carries its own annual fee. Any quote that does not name it is incomplete.

The legal basis asserted is section 35(1) of Canada’s Constitution Act, 1982, which recognises existing aboriginal and treaty rights. Tobique’s position is that regulating gaming on its own territory is one of them.

One licence covers online casino, live dealer through certified studios, fixed-odds and exchange sports betting, esports, peer-to-peer poker, digital lottery and keno, and fantasy sports, including crypto-denominated play.

Financial betting is excluded, which rules out forex and binary options, as are lotteries with physical prize draws. No local company, office or staff is required in Tobique or New Brunswick.

Key Criteria for Securing a Tobique Gambling License

Applicants must satisfy the Commission on four fronts, and files fail on documentation more often than on substance:

Corporate and ownership. Notarised and apostilled proof of incorporation, identification and proof of address for every director and beneficial owner, the ownership structure up to the natural persons, and clean criminal record certificates.

Source of funds. Bank statements for the last three months, plus source of wealth and source of funds evidence for every beneficial owner holding 10% or more.

Experience. Documented background and qualifications in online gaming for the people running the business.

Appointed roles. A Money Laundering Reporting Officer formally engaged under a letter or contract, not merely named on paper.

Policies. AML and CFT programme, responsible gambling policy covering self-exclusion, cooling-off periods, deposit, betting and session limits and links to support organisations, plus privacy policy, terms of use, bonus policy and a complaints procedure.

Commercial file. A three-year business plan covering target markets, revenue projections, game offering, responsible gaming approach and the AML and KYC framework, with financial projections and evidence you can fund them.

Technical file. Platform provider agreements, RNG testing certificates from a recognised laboratory such as iTechLabs, GLI or BMM Testlabs with return-to-player detail, pre-approval from a reputable game provider for B2C, daily encrypted backups with a Commission-approved provider, and integration with the self-exclusion database.

Website and domain. Evidence of domain ownership, and a live site carrying an active licence validator, an About Us section, responsible gambling resources, a complaints route, contact details and the policies above.

Every document must be in English and dated within ninety days, with certified translations where the original is in another language.

Is a Tobique Gaming License Legally Sound?

This is the question every serious operator asks, and the honest answer has three parts. Anyone who gives you only the first is selling.

The precedent is real. Kahnawake, a Mohawk community in Quebec, has licensed online gaming since its Gaming Law of 1996 and its interactive regulations of 1999, on exactly the same constitutional theory. In roughly three decades the legality of that law and of the Commission’s activities has never been successfully challenged under Canadian law or anywhere else, and large, well-known businesses have run on it throughout. Tobique is building on a tested route rather than inventing one.

But “never challenged” is not “upheld”. When the Quebec Superior Court considered a Kahnawake permit dispute in July 2007, it ruled in the Commission’s favour and expressly declined to rule on the validity of the gaming law itself. The core constitutional question has not been decided on its merits. It has been left alone, which is a different and less durable thing.

And the arrangement works partly through what it avoids. The licence prohibits serving players in New Brunswick, the province where Tobique sits, and in Canada generally outside First Nation frameworks. A licence that excludes its own host province is acknowledging a jurisdictional tension rather than resolving it. Kahnawake’s 2016 understanding with the New Jersey Division of Gaming Enforcement, under which it stopped licensing operators taking US customers, followed the same logic.

What that means in practice: Tobique is a workable licence for an operator serving grey and unregulated markets outside Canada, the United States, the United Kingdom and the regulated EU. It will not let you argue your way into a regulated market, and it should not be presented to investors or acquirers as equivalent to a Malta or Isle of Man authorisation. Used within its actual scope it does the job. Used outside it, no licence would have helped.

Markets You Cannot Serve

Around twenty jurisdictions are closed, and the list is revised. Effective geo-blocking with registration validation is a licence condition, not a recommendation.

New Brunswick, and Canada generally outside First Nation frameworks

The United States and the United Kingdom

Australia

Regulated EU markets, including France, Germany, Spain, Italy, the Netherlands, Belgium, Denmark, Sweden, Portugal, the Czech Republic, Romania and Lithuania

FATF high-risk jurisdictions subject to a call for action, which as of 19 June 2026 are North Korea, Iran and Myanmar

Jurisdictions under comprehensive sanctions, including Russia, Belarus and Syria

Two corrections to claims that circulate widely, including in older guides. The FATF blacklist contains three countries, not a long list, and China and Cuba are not among them. And sanctions are a separate regime from FATF listing: a country can be sanctioned without being FATF-listed, and the reverse. Your blocking has to be built against both, maintained, and evidenced.

Corporate Structure and Payments

The standard arrangement is two entities, and Tobique requires no local presence in either case.

Licence holder in Costa Rica. Costa Rica has no domestic online gambling regulation, so an operator licensed elsewhere raises no local licensing question, and the country runs a territorial tax system. BVI and Seychelles are also accepted. See offshore company formation.

Payment agent in Cyprus. A Cyprus entity handling processing gives you EU-facing banking and a settled legal environment. This is the part of the structure that determines whether you can actually take deposits, and it deserves as much attention as the licence.

The licence supports most fiat currencies and major cryptocurrencies. Where crypto is in scope, your AML programme has to handle on-chain risk properly, including wallet screening and source-of-funds treatment for crypto deposits. The Commission looks at this.

One plain statement on acceptance. Recognition among payment processors and software providers is growing and now reasonable, but it is not universal. Processors built around Malta and UK licensees will run additional due diligence, and some tier-one game providers ask for guarantees they would not ask of a Malta licensee. Test your specific payment and platform stack against the licence before you commit. We do that first rather than last.

Taxation

Tobique levies no gaming tax and no charge on gross gaming revenue. Only licence and compliance fees apply. That part of the marketing is accurate.

Costa Rica. Foreign-source business income falls outside the charge under the territorial system; local activity is taxed at progressive rates up to 30%. Two qualifications older guides omit. Costa Rica reformed its territoriality rules in 2023 under EU listing pressure, and foreign-source passive income now becomes taxable where the entity lacks adequate substance in the country. A licence-holding company with no people and no decisions taken locally is exactly the profile that reform targets. Separately, bill 25.796, filed by the Ministry of Finance on 22 September 2026, proposes a flat 15% charge on foreign interest, dividends, royalties, rents and capital gains for Costa Rican tax residents. It has been filed, not debated, and has no effective date. It is not a reason to avoid Costa Rica, but it is a reason not to build a structure that only works while today’s rules hold.

Cyprus. Corporate income tax is 15% from 2026, following the reform gazetted on 31 December 2025, up from 12.5%. Any page still quoting 12.5% was written before that, and the difference matters to a model built on thin processing margins.

Intercompany pricing between the two entities has to be defensible on arm’s length principles and documented. Margins chosen simply to land profit in the lower-taxed entity are the first thing a tax authority tests, and the structure fails on precisely that point when it fails.

And the part most pages skip: low tax in Costa Rica is not low tax for you. Your own country of residence may attribute the profits through controlled foreign company rules, or treat the company as resident where it is actually managed. We assess both sides first, as part of international tax planning.

What a Tobique Gambling License Costs in 2026

Preliminary review: EUR 2,500, non-refundable. Structural problems surface here, which is the point of paying it before the main fee.

Licence fee: EUR 33,500, refundable if the application is declined after the preliminary review clears. Total to the Commission: EUR 36,000.

DLAG compliance subscription: from EUR 7,000 per year, mandatory, typically covering up to five approved domains.

First year: roughly EUR 43,000 in official and compliance fees, or EUR 47,000 to 70,000 including company formation and application work, depending on how much of the file you build yourself.

Renewal from year two: around EUR 25,000 annually, plus the subscription. Renewal applications are due sixty days before expiry.

A note on the numbers you will see elsewhere. Published quotes for this licence run from USD 30,000 to EUR 70,000 for what is described as the same thing. Some of that spread is genuine service scope. Some is older fee schedules that were never updated, and some is quoting the Commission fee while leaving the mandatory subscription and the year-two renewal out of the comparison. Ask any provider for three figures separately: Commission fees, compliance subscription, and their own fee. If a quote will not break down that way, the comparison is not real.

How to Get a Gambling License in Tobique

Scope and structure. What you operate, for which markets, on whose platform. This decides the licence classes you need and whether any target market is closed outright.

Company formation. Most commonly Costa Rica, with BVI and Seychelles also accepted. No local entity in Tobique.

Document collection. The slowest stage and the one that sets your timeline. Criminal record certificates and apostilles are the usual bottleneck.

File preparation. Business plan, projections, AML and responsible gaming programmes, MLRO engagement, platform and provider agreements.

Preliminary review, then full submission. Beneficial owners at 10% and above are assessed, with source of wealth and source of funds confirmed.

Issue and go-live. Website compliance is verified and the licence validator must be active before launch.

Realistic timing is four to eight weeks from a complete submission, and two to four months from engagement once document collection is counted. Providers advertising two weeks are describing the regulator’s review window, not your project.

Tobique Compared With the Alternatives

Against Anjouan. This is the comparison that matters most in 2026, because the two are sold to the same buyer at a similar price, and they are not similar. The Central Bank of the Comoros investigated the Anjouan licensing bodies and described them as having no physical or legal existence and operating illegally, and the authority behind them was stripped of regulatory standing by Comorian banking legislation passed between 2013 and 2015. Published licence-verification links have returned errors. The IMF’s 2026 Article IV report on the Comoros makes no mention of gaming revenue at all. Tobique’s Commission, whatever the open constitutional question, exists, operates under a statute, keeps a verifiable register and sits inside a G7 country’s legal system. If you hold an Anjouan licence today, our page on the Anjouan gambling licence sets out where that leaves you.

Against Curacao. Curacao was the default offshore licence for two decades and its reform changed the calculation. The National Ordinance on Games of Chance passed in December 2024, old sub-licences expired in January 2025, the master and sub-licence model is gone, and the Curacao Gaming Authority now licenses directly. Direct licensing is a real gain in credibility and it costs accordingly, at roughly EUR 47,450 a year for B2C between treasury and supervisory fees, before application and compliance work. The transition has been rough, with the supervisory board resigning shortly after launch and a criminal complaint filed against a senior finance official over provisional licences. Curacao still carries wider recognition and broader B2B integration. Tobique is faster to obtain and cheaper to hold from year two. Neither is obviously right, and the answer depends on which software and payment partners you need.

Against Kahnawake. The same legal theory, three decades of track record, better name recognition, and a regulator with a documented enforcement history including the sanctions it imposed over the Ultimate Bet affair in 2009. Kahnawake is the more conservative choice on identical constitutional footing. Tobique is newer, cheaper and quicker.

Against Malta or the Isle of Man. A different product entirely. These are recognised authorisations that open regulated markets, tier-one payment relationships and institutional investment, at multiples of the cost and timeline. If a regulated European market is the plan, no offshore licence substitutes, and we would rather say so now.

Who Tobique suits, and who it does not

It suits an operator launching or relocating into grey and unregulated markets outside Canada, the United States, the United Kingdom, Australia and the regulated EU, who wants one licence across all verticals, crypto in scope, no local presence obligations and predictable annual costs. It suits operators leaving Anjouan, currently the most common reason clients come to us about Tobique. And it suits B2B suppliers whose operator clients have started asking what they are licensed under.

It does not suit anyone targeting a regulated market, anyone who needs tier-one game providers without additional guarantees, anyone whose investors or acquirers will test the licence against Malta-equivalence, or anyone running financial betting, which the licence excludes. It also does not suit an operator who wants a licence instead of compliance: quarterly financial reporting, annual compliance audits and prompt notification of material changes are conditions of keeping it.

    FAQ (Frequently Asked Questions)

What is a Tobique gambling license?

It is an online gaming licence issued by the Tobique Gaming Commission, the regulator of Tobique First Nation in New Brunswick, Canada, under the Tobique Gaming Act 2023. One licence covers online casino, live dealer, sports and esports betting, poker, digital lottery, keno and fantasy sports, including crypto-denominated play. Financial betting and physical prize lotteries are excluded.

How do I get a gambling license in Tobique?

Incorporate a company, most commonly in Costa Rica, then submit a file covering corporate and ownership documents, source of wealth for beneficial owners at 10% and above, a three-year business plan, financial projections, AML and responsible gambling programmes, an appointed MLRO, platform agreements, RNG certification and proof of domain ownership. A EUR 2,500 preliminary review comes before the main licence fee. No local entity or local presence is required.

How much does a Tobique gaming license cost?

EUR 36,000 to the Commission, split between a EUR 2,500 non-refundable preliminary review and a EUR 33,500 licence fee, plus a mandatory compliance subscription from EUR 7,000 a year. First-year total including formation and professional work runs EUR 47,000 to 70,000. Renewal is around EUR 25,000 a year from year two. There is no gaming tax and no charge on gross gaming revenue.

How long does it take to get a gambling license in Tobique?

Four to eight weeks from a complete submission, and two to four months from engagement once document collection and apostilles are counted. Quotes of two weeks describe the regulator’s review window rather than the project.

Can I trust a Tobique gaming license?

Within its scope, yes, and it stands up better than several licences sold at the same price. The Commission exists, operates under a 2023 statute, and rests on the same section 35(1) constitutional basis that Kahnawake has used since 1996 without a successful legal challenge.

The open question is that the constitutional theory has never been decided on its merits: when a Quebec court examined a Kahnawake dispute in 2007 it ruled for the Commission but declined to rule on the gaming law’s validity. Treat Tobique as a sound licence for grey and unregulated markets, not as equivalent to a Malta authorisation.

Which countries can I not serve with a Tobique license?

New Brunswick and Canada outside First Nation frameworks, the United States, the United Kingdom, Australia, regulated EU markets, the FATF high-risk jurisdictions subject to a call for action, which as of 19 June 2026 are North Korea, Iran and Myanmar, and comprehensively sanctioned states including Russia, Belarus and Syria. Around twenty in total, and the list is revised. Geo-blocking with registration validation is a licence condition.

Can I accept cryptocurrency with a Tobique gaming license?

Yes. The licence covers crypto-denominated play and most major coins and virtual assets alongside fiat. Your AML programme has to cover on-chain risk properly, including wallet screening and source-of-funds handling for crypto deposits, and this is an area the Commission examines.

Is Tobique better than Curacao or Anjouan?

Against Anjouan, yes, and the gap is wide: the Comorian central bank has described the Anjouan licensing bodies as having no legal existence and operating illegally.

Against Curacao it depends. The post-reform direct licence from the Curacao Gaming Authority carries wider recognition and broader B2B integration at roughly EUR 47,450 a year, while Tobique is faster to obtain and cheaper to hold from year two. Choose on which payment and software partners you actually need.
